Trademark Application

On my primary business, we are in the process of re-branding our business to a more generic name that would be more appealing to other consultants interested in helping in the practice. The name of the legal entity on which I hold my consulting practice remains the same, but we may want to add the “Also Known As” to extend the brand. For now, on my consulting practice I will be using Anes & Rincon LLC a.k.a. Actions and Results Consulting.
Two uncommon last names are not too much of an important branding property. However, a slogan or a business name is. That is why we wanted to register the name to avoid other people claiming it or using it on their own business. These days it is so easy to register a domain name and start making business under that name that we decided we needed some kind of protection. We have already seen people who like the name and try to claim similar, but not exact matches of the company’s webpage domain.
We have submitted the Actions and Results Consulting Trademark to the Federal Governement for approval. The Trademark Electronic Application System is very simple to use (a bit expensive, starting at $275). It is an 18 month process. But we now claim property of such name, and claims about the trademark are based on application filing date, not approval date.

The mark consists of standard characters, without claim to any particular font, style, size, or color.We have received your application and assigned serial number ‘77566263′ to your submission. In approximately 4-5 months, your application will be assigned to an examining attorney; however, the critical date for determining registrability is your filing date, NOT the actual examination date. You will not receive any further USPTO communications until examination. At this point, your mark is not registered it is only a “pending” application. The overall process, from the time of initial filing to final registration, can take 13-18 months, and even longer depending on many factors, e.g., the correctness of the original filing, or the type of application filed.”
Now we sit and wait for more than a year. Hopefully we can get some protection to the name.
